The Department's current Rulemaking activity is provided to allow the public to view all proposed rulemakings as well as final rulemakings that have not yet been published in the Arizona Administrative Code.

Article 1. Definitions and General Provisions and Article 3. Taking and Handling of Wildlife

The Commission proposes to amend R12-4-108, R12-4-301, R12-4-381, and R12-4-321 to implement recent legislative amendments to A.R.S. §§ 13-3107 and 13-3108, which transferred the authority to regulate the use of firearms for the take of wildlife within municipal boundaries to the Arizona Game and Fish Commission.

The Commission approved the Notice of Proposed Rulemaking at the December 2, 2011 Commission Meeting.

The Commission will review the final rulemaking at the March 9, 2012 Commission Meeting.

Article 1. Definitions and General Provisions

The Commission proposes to amend R12-4-121 to implement legislative amendments to A.R.S. § 17-332, which allows a grandparent to transfer their unused big game tag to their minor grandchild.

The Commission approved the Notice of Final Rulemaking at the February 3, 2012 Commission Meeting.

The Governor's Regulatory Review Council will review the final rulemaking at the June 5, 2012 Council Meeting.

Article 2. Miscellaneous Licenses and Permits

The Commission proposes to amend R12-4-202 to remove the requirement that the certification issued by the Disabled Veteran's Services include the applicant's date of birth.

The Commission approved the Notice of Final Rulemaking at the February 3, 2012 Commission Meeting.

The Governor's Regulatory Review Council will review the final rulemaking at the June 5, 2012 Council Meeting.

Article 4. Live Wildlife

The Commission proposes to amend R12-4-422 to ensure compliance with recently amended federal regulations governing falconry, 50 CFR Parts 21 and 22, which transferred the authority for sport falconry licensing to states.

The Commission approved the Notice of Final Rulemaking at the December 2, 2011 Commission Meeting.

The Governor's Regulatory Review Council will review the final rulemaking at the April 3, 2012 Council Meeting.

Notice of Exempt Rulemaking

Article 8. Wildlife Areas and Department Property

The Commission proposes to amend R12-4-802 and R12-4-803 to allow the Department to better manage the access and use of Commission-owned real property and facilities; R12-4-802 to restrict the use of all motorized vehicles to designated and administrative roads only in the Cibola Valley Conservation Area to protect sensitive wildlife habitat; establish restrictions for the new Fool Hollow Lake Wildlife Area; restrict overnight camping in designated areas of the Raymond Ranch Wildlife Area to limit wildlife and human conflicts; and establish restrictions for the Department controlled property Hirsch Conservation Education Area and Biscuit Tank; and R12-4-803 to establish boundary descriptions for the new Fool Hollow Lake Wildlife Area and Hirsch Conservation Education Area and Biscuit Tank.

The Commission approved the proposed Notice of Exempt Rulemaking at the December 2, 2011 Commission Meeting.

The Commission will review the final Notice of Exempt Rulemaking at the April 13, 2012 Commission Meeting.
